Waiver and Liability Release

PLEASE READ CAREFULLY AND THOROUGHLY BEFORE SIGNING.

The person signing this document acknowledges and sets forth that he or she has the capacity to enter into contracts and that they understand the terms set forth below. If the person who is to participate in our InflataPark attraction is less than eighteen (18) years of age, his or her parent or guardian must read this Agreement and provide initials and signatures below.

This is a waiver of your legal rights and an agreement to hold harmless The Bounce House Shreveport, LLC., its respective officers, directors, members, managers, employees, agents, heirs, family members, assigns, representatives, affiliated persons, and others acting on its behalf (hereafter referred to collectively as “The Released Parties”) from any liability, whatsoever; and to release it from all causes of action that may arise from your participation in the InflataPark attraction.

TERMS OF PARTICIPATION IN INFLATAPARK ATTRACTION

• Parents or event hosts must supervise children at all times. The Bounce House Shreveport, LLC is not responsible for unsupervised children on the property.
• Every patron entering the InflataPark play area is REQUIRED TO WEAR BOUNCE HOUSE BRANDED SOCKS, no exceptions.
• The minimum age of participants is 2 years of age.

Participant(s) agree(s) that he or she is voluntarily participating in the InflataPark activities. Such activities may include, but are not limited to jumping, bouncing, tumbling, running, play, and sitting. It is agreed on behalf of the Participant and for his or her heirs, assigns and representatives, that:

ASSUMPTION OF RISK.

Participant is aware that the INFLATAPARK and the participation in such activity has a risk of serious bodily harm or death. THERE IS AN INHERENT RISK OF PROPERTY DAMAGE, INJURY OR DEATH.

Participant and his or her parent or guardian acknowledges and agrees that no amount of care, caution, instruction, or experience can eliminate such dangers. Some dangers include but are not limited to, being thrown from or falling off the inflatable, being kicked, being struck by other children, being stomped on, being run into, and/or run over.

RELEASE FROM LIABILITY AND COVENANT NOT TO SUE

In consideration for being permitted to participate in the INFLATAPARK attraction, Participant agrees TO FOREVER DISCHARGE AND RELEASE FROM ANY LEGAL LIABILITY The Bounce House Shreveport, LLC., and/or any of The Released Parties, as described above, for any and all injuries or property damage caused by or resulting from Participant’s participation in the InflataPark Ride attraction.  PARTICIPANT HEREIN AGREES NOT TO SUE OR SEEK LEGAL ACTION AGAINST The Bounce House Shreveport, LLC., or any other Released Party.

INDEMINITY AGREEMENT

Participant agrees to INDEMNIFY AND HOLD HARMLESS The Bounce House Shreveport, LLC. and/or the Released Parties against any and all claims, demands, actions, liabilities, losses, or suits that are brought against The Bounce House Shreveport, LLC. and/or The Released Parties which are in any way connected with Participant’s participation in any activities conducted at any time and at any location while on the premises of The Bounce House Shreveport, LLC.

CHOICE OF LAW

This Waiver shall be interpreted and construed based on the laws of the State of Louisiana. Any dispute that arises herein shall be heard in the First Judicial District Court in Caddo Parish, Louisiana. If any clause conflicts with applicable law, only that clause will be null and void but the remainder of this document shall stay in full force and effect. Participant agrees to pay any attorney fees and costs for The Bounce House Shreveport, LLC and/or the Released Parties to successfully defend this Agreement.

By signing this agreement, you and your child are giving up certain legal rights, including the right to sue or recover damages in case of injury, death, emotional damage and/or property damage, for any reason.

You herein attest that “I have read this entire Waiver and Release of Liability document. I understand it is a promise not to sue and to release The Bounce House Shreveport, LLC. and The Released Parties from any and all claims. I have assessed all risks involved, make this decision of my own free will and consent to participate despite those risks.”
